The legal regime governing employment law in Switzerland basically distinguishes between public and private law, depending on whether the employment relationship is concluded with a public entity or private employers.

While employment relationships with employers of the private sector are fundamentally governed by individual work contracts, statutory provisions of the Swiss Code of Obligations and of the Swiss Federal Act on Employment in Trade and Industry as well as by collective labour agreements, employment relationships of federal, cantonal or local government personnel are subject to the public law governing the respective public entity.
